These Terms of Service ("Terms") govern your access to and use of the Plonk platform and the plonk.tools website, operated by PixelTowers ("we", "us", or "our"). By using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Plonk, you confirm that you are at least 16 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Description of Service

Plonk is an AI-powered infrastructure automation platform that helps engineering teams manage Kubernetes deployments, infrastructure provisioning, and operational tasks. Features and availability may change as we develop the product.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to our systems or other users' accounts.

5. Intellectual Property

The Plonk platform, including its software, design, logos, and documentation, is owned by PixelTowers and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.

Your data remains yours. We do not claim ownership of any content or configurations you create using Plonk.

6. Early Access and Beta

During early access or beta periods, the service may contain bugs or incomplete features. We provide early access services "as is" without warranty. We appreciate feedback and may use it to improve the product.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice when possible.

8. Limitation of Liability

To the maximum extent permitted by law, PixelTowers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claims related to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless PixelTowers and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the service ceases, and we may delete your account data after a reasonable retention period.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Continued use of the service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which PixelTowers is incorporated, without regard to conflict of law principles.
